This Privacy Policy also does not apply to information collected when you purchase our products in department and specialty stores that are not Steve Madden stores, or on other third-party websites where our products are sold. A. WHY WE COLLECT INFORMATION:

Code § 1798.80), such as name and contact information (payment card information (e.g., credit or debit card numbers) is not collected or stored by Steve Madden and is only processed by third-party providers);
  • Commercial information, including information about a consumer’s purchase, such as the items purchased, the price of the items, the payment method used, and whether the product was on sale;
  • Audio, visual, electronic or similar information, such as in-store video monitoring and call recordings created in connection with our business activities (e.g., customer service calls for training and quality control purposes);
  • Internet or other electronic network activity information, such as type of browser and operating system, search history, or information on a consumer’s interaction with our Website;
  • Approximate Geolocation Data, such as your current location; and
  • Protected classification characteristics under California or federal law, such as age (40 years or older).

In-Store Shopping

We have partnered with Leap Services, Inc. (“Leap”) to open and operate at least one of our physical retail stores. When you buy products or obtain services in such a store, Leap may ask you for certain personal information that it needs to process your purchase or provide you with the services you request. Please be aware that we are not responsible in any way for Leap’s privacy practices or for any use and/or misuse of any information that you provide to Leap. Leap’s privacy practices are subject to its own privacy policy, which we strongly suggest you review.

Personal information collected by Leap in connection with your in-store shopping experience may also be provided to us.

When you buy products or obtain Services in our stores, we ask you for information we need to process your purchase or provide you with the Services you request, such as your name, mailing address, email address, telephone number, zip code, or loyalty number.  Depending on the payment method you use, and only as permitted by applicable law, we may ask for more information to verify your identity or to prevent fraud, including a government-issued ID number (e.g., driver’s license, state identification number, passport, or other ID number). You may refuse to provide such information, but you may not be permitted to complete your purchase if we cannot verify your identity. If you do provide us with such information, you consent to it being used in accordance with this Privacy Policy. We may also collect information about your purchase, such as the items purchased, the price of the items, the payment method used, and whether the product was on sale.

We may also use in-store video monitoring for security, quality control and other purposes, such as helping us understand customer behavior and traffic patterns within our physical locations. In furtherance of our security policy, in-store video may be used, at our discretion, to assist law enforcement in investigations and may also be turned over to governmental authorities, agencies or others pursuant to an order issued or authorized by a court of competent jurisdiction. Images captured by our in-store video monitoring will be maintained for a limited period of time.

Job Applications and Postings

You may view job openings and apply for employment with us through our Website. If you submit a resume, job application, or related materials or other information to us, we may use that information to evaluate your qualifications and consider or respond to your inquiry or application. Your submission of a resume, job application, or related information does not in any way require Steve Madden to review that information or consider you for employment. C. HOW WE USE THE INFORMATION WE COLLECT

You may be able to post information and materials publicly, for example, in product reviews, chat areas, and other similar forums (collectively, “Forums”), subject to the Forum rules in our Terms of Use.  If you post any information in a Forum on the Website, it will be deemed public information and available to the general public.  Please do not post any personal information in a review or Forum.  We cannot guarantee that personal information you provide in a review or Forum will not be viewed by unauthorized persons. You understand that, even after removal, copies of personal information you provide in a review or Forum may remain viewable in cached and archived pages and may have been copied or stored by Internet archives and other Website users. G. CHILDREN’S PRIVACY

Right to Correct Inaccurate Information

You may have the right to request that we correct any inaccurate personal information that we have about you. Alternatively, you can use one of the contact methods outlined above, including submitting a verifiable consumer request.

Right to Request Deletion

You may have the right to request that we delete any personal information that we have collected from you.  However, we are not required to comply with a request to delete, if it is necessary for us to retain the personal information in order to:

Right to Opt-Out of “Sale” or “Sharing” of Personal Information

You may have the right to direct us to not sell your personal information or share your personal information for cross-contextual behavioral advertising purposes at any time (the “right to opt-out”). To exercise the right to opt-out, you (or your Authorized Agent) may 1) click “Your Privacy Choices” link in the footer of our Website and toggle off “Sale or Share of Personal Data” or “Advertising Cookies”, 2) email your request to opt-out to info@stevemaddendirect.com, or 3) set your browser to refuse all or some browser cookies or to alert you when cookies are being sent. However, if you do not consent to our use of cookies or select this setting you may be unable to access certain parts of our Website or use all the features of our Services. Once you make an opt-out request, we will wait at least 12 months before asking you to reauthorize personal information sales. However, you may change your mind and opt back into the sale of personal information at any time by adjusting your cookie preferences to accept all or certain cookies. Limited Right to Opt-In to “Sale” or “Sharing” of Personal Information

We do not sell the personal information of consumers we actually know are less than the Minimum Age, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is at least the Minimum Age, or the parent or guardian of a consumer less than the Minimum Age. Consumers who opt-in to personal information sales may opt-out of future sales at any time through the opt out methods described above.

Do Not Track Signals / Opt-Out Preference

California and Colorado law require us to let you know how we respond to web browser Do Not Track (“DNT”) signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of personal information about your online activities over time. This section of the Privacy Policy supplements, and should be read in conjunction with, the rest of the Privacy Policy.

  • Colorado Privacy Act (CPA)

  • Right to Confirm/Access

You have the right to submit a verifiable consumer request asking us to confirm whether we process personal information about you and to access your personal information, as well as to have such personal information provided to you in a portable (“data portability”) and, to the extent technically feasible, readily usable format. 

You may only submit a request for data portability no more than two (2) times per calendar year.

  • Personal Information Not Used for Certain Types of Profiling / Sensitive Personal Information Not Used 

We do not use your personal information to profile you in furtherance of decisions that produce legal or significantly similar effects (as may be defined under applicable law). We also do not knowingly collect any personal information that would be considered “sensitive” under applicable law.

I. EXERCISING YOUR RIGHTS – CALIFORNIA AND COLORADO RESIDENTS

You may visit the Data Privacy Portal to exercise your rights under the CCPA or the CPA or submit a verifiable consumer request to know, correction, deletion, or other applicable right through one of the following methods:

  • Submitting a request via email at info@stevemaddendirect.com entitled “CCPA Request” or “CPA Request”;
  • Clicking the “Your Privacy Choices” link in the footer of our Website and toggling off “Sale or Share of Personal Data” or “Advertising Cookies”; or
  • Coming in-person and submitting a request at one of our retail locations.

At this time, requests are not available in other states of residence. We will continue to monitor developing privacy legislation to ensure compliance and will update our privacy policy accordingly.

J. NOTICE OF FINANCIAL INCENTIVES & NON-DISCRIMINATION/BONA FIDE LOYALTY PROGRAM

We offer consumers a loyalty program, SM PASS, which consumers may opt-in to by signing up on our website at Join SM PASS. When consumers sign up for our loyalty program, they may be required to provide personal identifiers, including their first and last name, email address, and mobile telephone number. SM Pass is only available to consumers on our Website and at select Steve Madden store locations. The purpose of the SM Pass loyalty program is to encourage repeat business with Steve Madden and to enhance your shopping experience. See SM PASS Terms and Conditions for more information. Steve Madden will never discriminate against you if you choose to exercise any of the privacy rights described in this Privacy Policy.

Consumers may cancel their participation in this program at any time by contacting our customer service team at 1-888-526-2881, seven (7) days a week, between the hours of 9:00 AM to 10:00 PM Eastern Time. Generally, we do not assign monetary or other value to personal information. Under certain laws, these services may be considered a “financial incentive”. In such context, the value of a consumer’s personal information to us is related to the value of the discounted or free products or services or other benefits and rewards that the consumer obtains or that are provided to the consumer as part of the loyalty program, less the expense to us related to offering those products, services and benefits to the consumer as a participant in the program. The value may vary based on the amount the consumer purchases as a member of the program, the value of future offers that the consumer receives, and the extent to which the consumer uses those offers on future purchases from us. As an example, a 20% discount reward will vary in value to us depending on the products purchased by the consumer.

We do not collect any personal information or sensitive information through our loyalty program, SM PASS, that will be sold or processed for targeted advertising, nor will any third parties receive any personal information collected through the program. The loyalty program does not have any benefits provided by a program partner, nor does any loyalty program benefit require the processing of personal information for sale or targeted advertising. If you exercise your right to delete your personal information and it impacts your loyalty program membership and/or the ability to receive any program benefit, we shall notify you in accordance with applicable state law.

K. LINKS TO OTHER WEBSITES

For your convenience, the Website may contain links as a way of helping you locate related information and products easily.  However, when linking to another website, you must review that website’s privacy notice as other websites may not treat information collected online in the same manner as we do, and we are not responsible for the privacy practices, advertising, products, or the content of such other websites.

L. EMBEDDED CONTENT

The Services incorporate content, including feeds, scripts embedded in the Website’s code, and visible content, provided by third parties. In some cases, those third parties collect data about how you interact with their content. For example, our Website includes Google Maps features and content. Google Maps features and content is subject to the then-current versions of Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy.
