A. WHY WE COLLECT INFORMATION
We collect personal information in order to provide you with our products and services. In addition, your personal information helps us communicate to you our latest products, special offers, and information and events about which you might like to hear. Code § 1798.80), such as name and contact information (payment card information (e.g., credit or debit card numbers) is not collected or stored by Steve Madden and is only processed by third-party providers);
- Commercial information, including information about a consumer’s purchase, such as the items purchased, the price of the items, the payment method used, and whether the product was on sale;
- Audio, visual, electronic or similar information, such as in-store video monitoring and call recordings created in connection with our business activities (e.g., customer service calls for training and quality control purposes);
- Internet or other electronic network activity information, such as type of browser and operating system, search history, or information on a consumer’s interaction with our Website;
- Approximate Geolocation Data, such as your current location; and
- Protected classification characteristics under California or federal law, such as age (40 years or older).
In-Store Shopping
We have partnered with Leap Services, Inc. (“Leap”) to open and operate at least one of our physical retail stores. When you buy products or obtain services in such a store, Leap may ask you for certain personal information that it needs to process your purchase or provide you with the services you request. Please be aware that we are not responsible in any way for Leap’s privacy practices or for any use and/or misuse of any information that you provide to Leap. Leap’s privacy practices are subject to its own privacy policy, which we strongly suggest you review.
Personal information collected by Leap in connection with your in-store shopping experience may also be provided to us.
When you buy products or obtain Services in our stores, we ask you for information we need to process your purchase or provide you with the Services you request, such as your name, mailing address, email address, telephone number, zip code, or loyalty number. Depending on the payment method you use, and only as permitted by applicable law, we may ask for more information to verify your identity or to prevent fraud, including a government-issued ID number (e.g., driver’s license, state identification number, passport, or other ID number) for fraud prevention and security purposes. We do not store such government-issued ID information. You may refuse to provide such information, but you may not be permitted to complete your purchase if we cannot verify your identity. If you do provide us with such information, you consent to it being used in accordance with this Privacy Policy. We may also collect information about your purchase, such as the items purchased, the price of the items, the payment method used, and whether the product was on sale.
We may also use in-store video monitoring for security, quality control and other purposes, such as helping us understand customer behavior and traffic patterns within our physical locations. In furtherance of our security policy, in-store video may be used, at our discretion, to assist law enforcement in investigations and may also be turned over to governmental authorities, agencies or others pursuant to an order issued or authorized by a court of competent jurisdiction. Images captured by our in-store video monitoring will be maintained for a limited period of time.
Job Applications and Postings
You may view job openings and apply for employment with us through our Website. If you submit a resume, job application, or related materials or other information to us, we may use that information to evaluate your qualifications and consider or respond to your inquiry or application. Your submission of a resume, job application, or related information does not in any way require Steve Madden to review that information or consider you for employment. With regard to credit and debit card payment, all credit and debit card information is provided directly to our third-party payment processor. J. NOTICE OF FINANCIAL INCENTIVES & NON-DISCRIMINATION/BONA FIDE LOYALTY PROGRAM
We offer consumers a loyalty program, SM PASS, which consumers may opt-in to by signing up on our website at Join SM PASS. When consumers sign up for our loyalty program, they may be required to provide personal identifiers, including their first and last name, email address, and mobile telephone number. SM Pass is only available to consumers on our Website and at select Steve Madden store locations. The purpose of the SM Pass loyalty program is to encourage repeat business with Steve Madden and to enhance your shopping experience. See SM PASS Terms and Conditions for more information. Steve Madden will never discriminate against you if you choose to exercise any of the privacy rights described in this Privacy Policy.
Consumers may cancel their participation in this program at any time by contacting our customer service team at 1-888-526-2881, seven (7) days a week, between the hours of 9:00 AM to 10:00 PM Eastern Time. Generally, we do not assign monetary or other value to personal information. Under certain laws, these services may be considered a “financial incentive”. In such context, the value of a consumer’s personal information to us is related to the value of the discounted or free products or services or other benefits and rewards that the consumer obtains or that are provided to the consumer as part of the loyalty program, less the expense to us related to offering those products, services and benefits to the consumer as a participant in the program.
